Conflicts about rights to a domain name can be decided upon by the Alternative Dispute Resolution Committee, an independent extrajudicial tribunal. Domain conflicts can also be brought to court. A decision from the ADR Committee does not bind the court with regard to further process.
Two types of conflicts involving domain names can arise:
- A dispute about the domain name itself
- A dispute about the content under the domain
Under normal circumstances, Norid is not a party to these conflicts, nor do we need to be in order to be able to take any necessary actions.
In cases where a legally binding decision has been made, the domain name policy provides the authority we need to either transfer or delete a domain name, or to carry out other operations without the holder’s consent. The prerequisite is that the claim in the decision is worded in such a way that they can be executed without coming into conflict with the agreement between Norid and the domain name holder, or the domain name policy in general.
